GENERAL TERMS AND CONDITIONS OF OPEN DATABASE LICENSE FOR THE PLANT METABOLIC NETWORK DATABASES
The license under which the AraCyc, PlantCyc, and PlantCyc-derived databases developed by the Plant Metabolic Network (PMN)(Databases) may be distributed will be on substantially the terms and conditions set forth below. Carnegie Institution, Department of Plant Biology, (Carnegie) reserves the right to modify these terms in a manner that does not materially alter their meaning.
1. SCOPE OF LICENSE:
The Databases may be used, royalty-free, for any and all purposes worldwide. License includes right to modify and to redistribute the Databases, provided that any modified copies of the Databases, or websites from which such modified copies may be obtained, must clearly and prominently (i) identify the Database(s) from which they were derived; (ii) include all applicable copyright notices and author lists from the Database(s) from which they were derived; and (iii) identify or summarize all modifications that were made
2. TITLE:
Title to the Databases resides and remains with Carnegie and its licensors. Licensees obtain no ownership rights, and use rights are subject to the limitations set forth in the license grant.
3. TERMINATION:
Licensee may terminate this license by erasing or destroying all electronic and hard copies of the Databases and any of their components. Carnegie may terminate this license if the licensee breaches any of its material terms.
4. EXPORT CONTROLS:
The Databases are subject to United States export controls and may not be installed, downloaded or otherwise exported or re-exported (i) into (or to a national or resident of) any country as to which the U.S. has embargoed goods; or (ii) to anyone on the U.S. Treasury Department's list of Specialty Designated Nationals or the U.S. Commerce Department's Table of Deny Orders.
5. WARRANTY DISCLAIMER:
All warranties are disclaimed, including but not limited to warranties of fitness for intended purpose, of merchantability, and of non-infringement of third-party intellectual property. The Databases are provided As Is, and neither Carnegie nor its licensors warrant that the functions contained in the Databases will be uninterrupted or error free, that defects will be corrected, or that the Databases are free of viruses or other harmful components.
6. LIMITATION OF LIABILITY:
Carnegie and its licensors disclaim, and will not be responsible for, any special, incidental, consequential, punitive, or other damages arising from licensees or their distributees use of the Databases, even if they have been specifically warned of the possibility thereof. Licensees use of the Databases is entirely at Licensees own risk.
7. UPDATES AND NEW RELEASES:
Carnegie and its licensors shall have no obligation to release or distribute any updates to or new releases of the Databases. Any updates or new releases of the Databases which Carnegie or its licensors choose, at their own discretion, to distribute shall be subject to the terms hereof.
8. GOVERNMENT RIGHTS
This license may be subject to the reservation of certain rights in favor of the United States Government pursuant to Title 35 United States Code Chapter 18 and the regulations promulgated thereunder.
